Phoenix couple with children from a prior marriage died without wills or a trust and left assets in their individual names as tenants in common.  DeAngelis Legal opened informal probates for each spouse’s intestate (without a will) estate.  The probate allowed the appointed personal representative with the power to take control over the property and transfer it to the appropriate beneficiaries as provided under Arizona law.  It is unclear whether the division is consistent with the couple’s desire, but without wills, the beneficiaries were left no choice but to follow Arizona’s law for intestate succession.
