Financial Power of Attorney
A financial power of attorney grants another to make financial decisions on your behalf if you are unavailable. The power can be general and very broad or limited to certain transactions, such as transferring your assets to your revocable trust. The power may be drafted so that it becomes effective immediately or “springing,” meaning it becomes effective upon an event such as your incapacity. It is the rare situation where we recommend using an immediately effective general power of attorney because of the broad authority granted in the instrument and the potential for misuse. More commonly we will use a limited springing financial power of attorney and name the same person you name to manage your financial affairs in other documents to minimize the potential for conflicts.
Healthcare Power of Attorney
A healthcare power of attorney grants another the right to make medical decisions on your behalf if you are unable to communicate your desires. Your agent will communicate with your health care provider to determine what course of action they will take regarding your medical care. It is important to name someone you are comfortable making such decisions on your behalf and those persons may be different from those who you appoint to administer your financial affairs.
